For all Non Domestic or Commercial buildings a Building Energy Rating (BER) and advisory report are to be supplied to the prospective buyer or tenant when the building is constructed, sold or rented.
What happens if I don't get a BER Cert?
Failure to produce a printed copy of the BER Certificate to an authorised officer of the building control authority may fine up to €5,000.
I have a premises for which planning was received before 1 July 2008, do i need a BER Cert?
YES as of 1st January 2009 BER of existing buildings, when offered for sale or rent are compulsory.
For all new Non Domestic buildings offered for sale or rent since 1st January 2009 BER Certificates are also complusory.
A BER is gives prospective buyers and tenants useful information on the energy performance the building. The BER gives builders, developers, vendors and landlords an incentive to upgrade the energy performance of the building, which reduces energy costs for themselves and future owners/occupiers.
The BER is an indicator of energy performance covering energy use for space heating and cooling, water heating, ventilation and lighting, calculated on the basis of standard operating patterns. It is accompanied by a CO2 emissions indicator.
The Advisory report accompaning the BER gives recommendations on improvements that can be made to encrease the energy rating of the building. The parties involved are not legally obliged to carry out these improvements.
You must contact a registered Commercial BER Assessor to carry out your assessment. The assessor will follow the Non Domestic Energy Assessment Procedure (NEAP) and calculate your BER and complete the advisory report. The assessment is then submitted for publication on the national BER Register.
